Terms of Service

1. Who may use the Bots

You may use the Bots only if you are permitted to use Discord under Discord’s Terms of Service and applicable law. Upo Team does not independently verify users’ ages.

You are also responsible for following Discord’s rules and any rules set by the Discord server in which a Bot is used.

2. The services

Upo Bot

Upo Bot provides recreational commands, including image-to-GIF conversion, random cat images, profile picture display, and basic Discord account information.

Upo Giveaway

Upo Giveaway provides tools that server owners and server managers may use to create, manage, end, and reroll giveaways and to configure participation requirements.

3. Free access and Upo Plus

The standard versions of both Bots are currently free to use.

4. Giveaway responsibility

Upo Giveaway is only a technical management tool. Upo Team does not organize giveaways created through the Bot, even when a member of Upo Team uses the Bot as an administrator of a Discord server.

The server owner, server managers, or other person creating a giveaway is the giveaway organizer and is solely responsible for:

• the legality and rules of the giveaway;
• the accuracy of the prize name, description, and requirements;
• selecting appropriate participation requirements;
• providing and delivering the promised prize;
• handling winner verification, rerolls, cancellations, and disputes;
• any taxes, fees, restrictions, or legal obligations related to the prize; and
• complying with Discord’s rules and applicable law.

Prize names and descriptions shown by the Bot are text entered by the organizer for display purposes only. The Bot does not hold, verify, transfer, or deliver prizes. Upo Team does not guarantee that a prize exists, has the stated value, or will be delivered.

Upo Team does not enter, end, reroll, cancel, or otherwise manage giveaways created by third-party server administrators. Questions or disputes about a specific giveaway should be directed to that server’s owner or management team.

5. Acceptable use

You must not use either Bot to:

• break applicable law, Discord’s rules, or another person’s rights;
• create, send, display, or promote illegal, harmful, or abusive content;
• upload images or other content that you do not have the right to use;
• exploit bugs, vulnerabilities, unintended behavior, or technical limitations;
• circumvent giveaway requirements or manipulate eligibility checks;
• use alternate accounts, fake activity, automated messages, or artificial invites to gain an unfair advantage;
• spam commands or deliberately overload, disrupt, reverse engineer, or interfere with the Bots or their infrastructure;
• impersonate Upo Team or falsely claim that Upo Team endorses a giveaway; or
• use the Bots in any way that may harm users, Discord communities, Upo Team, or the services used to operate the Bots.

Users and server administrators are responsible for the commands, content, giveaway descriptions, requirements, and actions they submit. Upo Team does not continuously monitor all activity and is not responsible for unlawful or improper conduct by users or server administrators. When misuse is reported or discovered, Upo Team may take action at its discretion.

6. Suspension and termination

Upo Team may restrict, suspend, or permanently block any user, server, or use of the Bots at any time and at its discretion, with or without prior notice. This may include situations involving suspected misuse, abuse, security risks, violations of these Terms, violations of Discord’s rules, or any other reason Upo Team considers appropriate.

Upo Team is not required to provide access to the Bots, explain every enforcement decision, or restore access after a restriction.

7. Availability and changes

The Bots are provided on an “as is” and “as available” basis. They may contain errors, experience interruptions, lose access to Discord data, or stop working because of maintenance, technical failures, hosting issues, Discord changes, missing permissions, or other causes.

Upo Team may add, remove, limit, modify, suspend, or discontinue any feature or either Bot at any time. No particular uptime, response time, data recovery, feature availability, or continued support is guaranteed.

If you encounter a problem, contact ejten on Discord or use the Upo Team support server. Upo Team will try to investigate and fix reasonable issues where possible, but cannot guarantee that every issue can or will be fixed.

8. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, Upo Team makes no warranties regarding the reliability, accuracy, availability, security, or suitability of the Bots or any giveaway managed through them.

Upo Team is not responsible for prizes, prize descriptions, user content, server rules, organizer conduct, participant conduct, unfair or unlawful giveaways, lost entries, incorrect eligibility results, unavailable data, deleted messages or channels, failed rerolls, service interruptions, or decisions made by server owners and managers.

To the maximum extent permitted by applicable law, Upo Team will not be liable for indirect, incidental, special, consequential, or punitive losses, or for lost data, lost opportunities, lost prizes, lost profits, or damage resulting from the use of or inability to use the Bots. Nothing in these Terms excludes liability that cannot legally be excluded.

9. Privacy

Information processed through the Bots is handled as described in the Privacy Policy. By using the Bots, you acknowledge that the information necessary to provide their functions will be processed as described there.

10. Changes and contact

Upo Team may update these Terms when the Bots, their features, or the rules applying to them change. The date at the top of this page shows the latest revision. Continued use of the Bots after an update means that you accept the revised Terms.
